Fair Care for All: Why AB 1876 Matters for Our Communities

At The TransLatin@ Coalition, we believe that everyone deserves access to health care that is safe, affirming, and free from discrimination. Yet across the country, the protections that ensure equitable health care are under threat.

That is why The TransLatin@ Coalition is proud to sponsor Assembly Bill 1876 (AB 1876), the Fair Care for All Act, a critical piece of legislation that would protect Californians from discrimination in health care programs that receive government funding.

What is AB 1876?

AB 1876 would codify federal nondiscrimination protections from Section 1557 of the Affordable Care Act (ACA) into California state law. These protections prohibit health care providers receiving federal funds from denying care based on race, color, national origin, sex, age, or disability.

These safeguards are essential for communities that have historically faced discrimination in health care, including LGBTQIA+ people, immigrants, non-English speakers, and people seeking reproductive health care.

By placing these protections into California law, AB 1876 ensures that they remain in place even if federal protections are weakened.

Why This Bill Is Needed Now

Recent federal actions have created serious uncertainty about the future of nondiscrimination protections in health care. Executive orders have directed federal agencies to review the legality of these protections and have attempted to restrict access to gender-affirming care.

The impact is already being felt.

Major health care institutions have begun scaling back gender-affirming services due to federal pressure and legal intimidation. This has created fear and instability for transgender youth, their families, and many others who rely on inclusive health care systems.

Without strong protections, vulnerable communities, including transgender people, immigrants, and people of color, face the real risk of being denied care.

What AB 1876 Will Do

The Fair Care for All Act will:

  • Protect nondiscrimination protections in California regardless of federal rollbacks

  • Ensure protections apply to all government-funded health programs and activities

  • Safeguard equitable access to care for vulnerable communities

  • Strengthen California’s commitment to health equity and civil rights

By codifying these protections at the state level, AB 1876 helps ensure that no one in California is denied care because of who they are.
